Professional Experience
I spent the first half of my career concentrating my practice in corporate defense handling employment matters. I have extensive trial experience representing companies against employee claims such as alleged Illinois human rights violations, State and Federal discrimination claims, Wage claims, non-compete/non-disclosure claims, breach of contract and sexual harassment claims. I have won every employment case that has gone to trial, but as importantly I have been successful at having the majority of claims brought against companies dismissed at the early stages of the investigation or litigation avoiding the expense of costly trials.
I also have extensive experience in health law related litigation, regulatory action defense and health care consulting. Over the last 20 years, I have successfully represented numerous health care providers in reimbursement claims against managed care companies, billing companies and claims for and against the Centers for Medicare and Medicaid Services and the Illinois Departments of Public Health and Public Aid. As a core part of my practice I have represented hospitals, pharmacies, home health agencies, nursing homes, assisted living facilities, medical equipment suppliers & manufacturers, physical therapy businesses and physician practices in a myriad of legal cases ranging from recoupment actions, Level A violations, Plan of Care preparation, decertification actions, fraud and abuse claims, IDPA and IDPH survey actions to partner and practice disputes.
As part of my legal services, I have an open question policy for any client to utilize to ask routine questions and receive answers without being charged if the question can be answered within thirty minutes. In my experience most questions can be answered within that time frame. As co-head of the employment and health care departments at the last two firms I worked with, I have spent a great deal of time consulting with businesses to insure that their policies and procedures, employee handbooks, contracts and general business practices are in compliance with laws and regulations applicable to your business.
I also provide consulting services to health care clients concerning accreditation issues, compliance and billing questions and fraud and abuse. My goal is to bring you into compliance so you do not need a trial lawyer, but also to prepare you to defend and win if a claim should be brought against you.
My experience is not limited to employment and health care matters. I also bring extensive trial experience to bear in a variety of commercial disputes, including shareholder disputes, business torts, business divorces, actions for emergency relief, construction disputes, breach of contract and unfair competition disputes to name a few. During my tenure at two large firms in Chicago, I was assigned to the complex litigation team wherein I handled cases with claimed damages above three million dollars. In this capacity, I won every bench and jury trial I tried in litigation throughout the United States.
Business Experience
What sets me apart from other attorneys with big firm litigation experience is my business experience both as in-house counsel of an international company and owner/operator of four successful health care companies. After winning two multi-million dollar trials on behalf of Katy Industries, I was hired to act as in-house counsel to oversee all litigation pending against the over two hundred Katy companies worldwide. In this capacity, I oversaw the human resources, risk management and environmental departments on behalf of the companies. I handled hiring and firing issues for the companies, policy & procedure formulation and negotiated insurance contracts and self insured retention rates. I also handled all environmental claims brought against the Katy companies.
Subsequent to acting as In-house counsel for Katy Industries, I became the President of Vital Products, Inc. responsible for the day to day operations of a Chicago land medical equipment company. While operating Vital Products, Inc. I also opened and operated two pharmacies and an oxygen company. Each of these companies has operated successfully and given me invaluable insight into my clients' perspective as business people on the realities of running a business and what is important when hiring an attorney. During my tenure over the past 15 years running businesses, I have had to hire multiple attorneys to handle matters on my behalf and it has given me a very different perspective on how to be a good attorney on behalf of my clients.
