Labor and Employment Practice
We concentrate in labor and employment law at both the state and federal level. Our experience in this area of the law includes:
- Litigating discrimination, harassment and/or retaliation claims before federal and state agencies and courts, and developing and implementing compliance programs and other proactive employment practices designed to help avoid such claims;
- Litigating breaches of the duty of loyalty and fiduciary duty, including employee theft and espionage;
- Preparing and enforcing confidentiality agreements, restrictive covenants and non-competition agreements;
- Ensuring compliance with employment laws, such as the Family and Medical Leave Act, the Fair Labor Standards Act, the Americans with Disabilities Act, Title VII, the Age Discrimination in Employment Act, the Uniformed Services Employment and Reemployment Act, and other state and federal employment statutes;
- Preparing employee handbooks, counseling management with regard to employee leaves of absence, discipline and termination, employee drug testing and employee assistance programs;
- Planning and implementing reductions-in-force;
- Counseling on the formation, termination, and the risks and benefits of employment and independent contractor relationships;
- Preparing severance agreements and releases;
- Counseling with regard to the payment of wages, and defending wage claims before agencies and courts;
- Counseling and litigation with regard to allegedly delinquent contributions to employee pension, health, and training funds; and
- The interpretation and application of collective bargaining agreements.
